ACIDC Recruitment Privacy Notice

In recruiting and hiring for open positions, ACIDC and its programs, subsidiaries, and affiliated entities collect and process Personal Information relating to job applicants, candidates, and prospects. ACIDC’s Recruitment Privacy Notice (“Notice”) explains how ACIDC collects, uses, and discloses the Personal Information we process when recruiting and hiring new employees, contractors, volunteers, and program staff. It also provides information about exercising any rights you may have with respect to your Personal Information and the steps we take to protect your Personal Information. By engaging with ACIDC’s recruitment process, you acknowledge that your Personal Information will be processed in accordance with this Notice. This Notice applies to all individuals who interact with ACIDC as part of a recruitment or hiring process, regardless of the medium through which they apply, and regardless of the ultimate outcome of that process.

Our processing of your Personal Information may vary depending on whether you are an applicant (individuals who have submitted an application for an open position), a candidate (individuals who are actively communicating with an ACIDC recruiter or HR representative, have applied for a role but were not hired, or were referred to ACIDC by an existing team member, recruitment agency, or community partner), or a prospect (individuals who are not actively communicating with an ACIDC recruiter and have not applied for a role at ACIDC). Our processing of your Personal Information may also differ depending on the country or jurisdiction in which the role you apply for is located, as well as the nature of the role — whether it is a paid employment position, a contracted engagement, a volunteer placement, or a grant-funded program role. ACIDC is committed to handling your Personal Information transparently, lawfully, and responsibly at every stage of the recruitment process, and this Notice is intended to give you clear and comprehensive information about how we do so.


Who Collects and Is Responsible for Your Personal Information

Where relevant under applicable privacy laws, the ACIDC entity or program office that you apply to will be the controller of the Personal Information that we collect, and process as set out in this Notice. This means that this entity is responsible for deciding how we store and use your Personal Information related to your employment or engagement application. As data controller, ACIDC determines the purposes and means of processing your Personal Information and bears primary responsibility for ensuring that such processing is carried out in compliance with applicable data protection legislation, including but not limited to the General Data Protection Regulation (GDPR), the UK General Data Protection Regulation (UK GDPR), the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and any other applicable federal, state, or local privacy laws.

If you are unsure which ACIDC entity or program office is the data controller in your case, please contact us at privacy@acidc.site. A member of our data protection or HR team will respond to your inquiry and provide you with the information you require to identify the relevant data controller for your application.

If you are in the European Economic Area (“EEA”) or the United Kingdom (“U.K.”), the entity you apply to will act as a joint controller with ACIDC’s principal office, meaning that this entity and ACIDC’s principal office jointly determine and are responsible for how your Personal Information is used. This arrangement is governed by an internal joint controllership agreement that allocates responsibilities for compliance between the entities involved. Information about how responsibility is allocated between joint controllers in relation to your Personal Information is set out at the end of this Notice, in the section titled “Allocation of Responsibility Between Joint Controllers.” Notwithstanding this allocation, you may contact either party in relation to requests or complaints concerning your Personal Information.

In this Notice, references to “ACIDC,” “we,” “us,” or “our” are to the ACIDC entity or program office that you apply to, or (in the case of individuals in the EEA or U.K.) to that entity and ACIDC’s principal office collectively. Where this Notice refers to ACIDC’s obligations as data controller or joint controller, those obligations are shared between the relevant entities to the extent set out in the allocation of responsibility described in this Notice.


Types of Personal Information ACIDC Collects

As part of the recruitment and application process, ACIDC may collect Personal Information from or about you. ACIDC operates across multiple jurisdictions and in partnership with national and international organizations that impose differing requirements relating to the collection of Personal Information. As a result, ACIDC may not collect all of the Personal Information identified in this section about all job applicants, candidates, or prospects. The information we collect from or about you may vary depending on the location of the position to which you apply and the nature of the role — whether it is an employed, contracted, volunteer, or grant-funded position. The Personal Information we collect may also vary depending on where you are in the recruitment and hiring process, the requirements of the specific program or department you are applying to, and any applicable legal or funder-imposed obligations that govern the position.

Before ACIDC Makes a Conditional Offer

Prior to making a conditional offer of employment or engagement, ACIDC may collect or direct the collection of the following categories of Personal Information. These categories reflect the information that ACIDC reasonably requires to assess your suitability for the role and to progress your application through the recruitment process in a fair, consistent, and lawful manner:

  • Contact Details — including your name, home address, email address, and telephone number(s), which ACIDC uses to communicate with you throughout the recruitment process and to send you information about the status of your application;
  • Qualifications — information about your skills, education, licenses, experience, certifications, and professional memberships that are relevant to the role for which you are applying, or that demonstrate your broader suitability for roles within ACIDC’s programs and operations;
  • Employment Information — information about your employment history, the responsibilities you have held, and the professional achievements you have accumulated, which assist ACIDC in evaluating your experience and competence;
  • Disability Information — if you choose to disclose this information, whether you have a disability for which ACIDC needs to make reasonable accommodations during the recruitment process, and information about any disability for which you seek an accommodation. This information is collected solely for the purpose of ensuring equitable participation in the recruitment process and is treated with the highest degree of confidentiality;
  • Eligibility Information — information about your eligibility to work in the jurisdiction where the role is posted, information about your eligibility to access program-sensitive or grant-restricted information or materials, information about any restrictions imposed upon you by a former employer or professional regulatory body, and information about any conflicts of interest relevant to the role or to ACIDC’s program operations and funding relationships;
  • References and Recommendations — contact details for professional references and any written recommendations submitted with your application, which ACIDC may use to verify your employment history and assess your character, professional conduct, and suitability for the role;
  • Video and Still Images — if you engage in a virtual interview with us, video and still images of you, which may include a copy of your government-issued identification, during the interview process for the purpose of verifying your identity and maintaining the integrity of our remote recruitment process.

Where permitted by applicable law, ACIDC may also collect Personal Information that you make publicly available on social media or professional networking profiles (such as LinkedIn, professional association directories, or community organization websites). Any such information collected will be limited to what is relevant to your application and will be handled in accordance with this Notice and applicable data protection law.

We will also create Personal Information in the course of the recruitment process, such as interview notes, scoring sheets, evaluator assessments, and internal communications relating to your application. This created information forms part of the record of your application and is retained in accordance with the data retention practices described in this Notice.

Sensitive Personal Information

Some of the Personal Information ACIDC collects from or about you may be Sensitive Personal Information or Special Category Data, as defined by applicable data protection laws. Sensitive Personal Information and Special Category Data receive heightened protection under applicable law and are processed by ACIDC only where a valid legal basis exists for doing so, whether that is your explicit consent, compliance with a legal obligation, or another permitted ground under applicable law. ACIDC may collect Sensitive Personal Information or Special Category Data when you visit an ACIDC facility or partner location, or when you voluntarily provide us with such information as part of the application process.

If you visit an ACIDC office or partner facility as part of the recruitment and hiring process, ACIDC may collect a copy of or information relating to a government-issued form of identification, such as your driver’s license or passport, for visitor access and security purposes. This information will be retained only for as long as is necessary for the purpose of the visit and will be handled in accordance with ACIDC’s visitor management policies.

Where permitted by applicable law, we may also ask you to voluntarily provide the following information when you apply for a position: your place of birth, gender, race or ethnicity, disability status, and veteran or national service status. We collect this information to comply with legal and regulatory requirements and to measure the diversity and inclusivity of our applicant pool in support of ACIDC’s organizational mission, which is rooted in advancing the social, economic, and cultural well-being of Afro-Caribbean and other underserved communities. We do not use information about your gender, race, ethnicity, disability status, or veteran status to evaluate your application or to make any employment decision. This information is maintained separately from your application materials and is accessible only to those ACIDC personnel responsible for diversity monitoring and compliance reporting. We may also collect information about your membership in a trade union or professional association if you provide us with this information and we are permitted to process it under applicable data protection laws.

After ACIDC Makes a Conditional Offer

After making a conditional offer of employment or engagement, ACIDC may collect or direct the collection of the following categories of Personal Information, as permitted by applicable law. These additional categories of information are generally required to verify your identity, confirm your eligibility for the role, and satisfy any legal or programmatic requirements associated with the position:

  • Biographical Information — your date of birth and information about your citizenship, including any dual citizenship or former citizenship, which may be required for eligibility verification in roles that are subject to funder requirements or jurisdictional restrictions;
  • Identity Verification Documents — copies of or information relating to government-issued identification, such as your driver’s license, passport, or national identity card, required for right-to-work verification and to satisfy any applicable onboarding documentation requirements;
  • Consumer Report — information about your education history, employment verification, credit history (where role-relevant and legally permitted), court records, and criminal history background check results, collected to ensure the integrity of ACIDC’s programs and to comply with any applicable legal or funder requirements;
  • Drug Screen Information — information relating to the completion of and results of any required drug testing, to the extent required and permitted under applicable law, including where such testing is mandated by a program funder, partner organization, or applicable regulatory authority;
  • Medical or Occupational Health Certificates — if required by regulatory authorities or the nature of the role to determine your fitness or eligibility, particularly for roles involving direct community engagement, health-related program delivery, or work in regulated environments.

For applicants in jurisdictions with pre-offer restrictions (such as New York City or other localities with “ban the box” or similar legislation), ACIDC may extend a contingent offer before collecting information relating to employment, education, drug, and consumer verification checks. If those checks are successfully completed, ACIDC may extend a conditional offer prior to collecting information in connection with the performance of additional background checks, as permitted by applicable law. ACIDC endeavors to comply with all applicable pre-offer and post-offer restrictions and will adapt its process accordingly based on the jurisdiction in which a role is located.

After You Withdraw from the Recruitment Process or ACIDC Determines Not to Proceed With Your Application

After you withdraw from the recruitment process, or after ACIDC determines not to proceed with your application, ACIDC may — with your consent or where otherwise permitted by applicable law — collect the following categories of Personal Information for the purpose of maintaining contact with you regarding future opportunities that may be a good fit for your skills and experience:

  • Contact Information — to determine if you would like to be considered for future roles at ACIDC or with our partner organizations, and to maintain an active talent community of individuals who have expressed an interest in working with or supporting ACIDC’s programs;
  • Employment Information — to determine if you are suitable for future roles at ACIDC or with affiliated program partners, based on the skills, experience, and qualifications you have previously demonstrated;
  • Work Availability and Preferences — to determine if you are still available and searching for a role, your work location preference, commuting preference, schedule preferences, desired compensation or remuneration, and your interest in volunteer, part-time, or grant-funded opportunities in addition to permanent positions;
  • Call Records — including recordings of calls we make to you, where needed for record-keeping and/or training and quality monitoring purposes, as permitted by applicable law. You will be informed at the beginning of any call if it is being recorded, and you will have the opportunity to decline the recording of that call.

Sources of Personal Information ACIDC Collects

ACIDC collects Personal Information about job applicants, candidates, and prospects from a variety of sources. We may collect your Personal Information directly from you when you voluntarily provide it to us. The primary circumstances in which we collect Personal Information directly from you include:

  • as part of your application for a position or engagement submitted through ACIDC’s online application portal, by email, or in any other format ACIDC makes available;
  • during an interview, assessment, skills test, or other evaluation conducted as part of the recruitment process, whether in person or through a virtual platform;
  • when you join our talent community or mailing list to be notified of future opportunities with ACIDC and its affiliated programs;
  • when you provide information to an ACIDC representative at a job fair, community event, career event, educational institution visit, or any other outreach activity conducted by ACIDC;
  • when you visit an ACIDC office or partner facility in connection with a recruitment or selection activity; and
  • when you otherwise communicate with ACIDC staff, volunteers, or representatives in a context that is relevant to your actual or potential application for a role.

We may also collect Personal Information about you from third parties where this is permitted by applicable law and where such collection is necessary for the purposes described in this Notice. The third-party sources from which we may collect your Personal Information vary depending on the stage of the recruitment process. For example, as permitted by applicable law, we may collect Personal Information about you from the following sources prior to extending a conditional offer of employment or engagement:

  • job boards, community career platforms, professional networking sites, and data aggregators who provide us with information about potential candidates and prospects for use in recruiting qualified applicants for ACIDC’s programs and operations;
  • any references you provide or, if ACIDC is taking over a program, project, or contract, from your current or former employer or program partner; and
  • any individual who refers you to us as a candidate for an open position, including existing ACIDC staff, volunteers, community partners, or alumni of ACIDC programs.

As permitted by applicable law, we may collect Personal Information about you from the following sources after extending a conditional offer of employment or engagement:

  • consumer reporting agencies and background investigation providers engaged by ACIDC to conduct pre-employment checks required by law, organizational policy, or program funder requirements; and
  • service providers who conduct drug screening, occupational health screening, or other pre-placement health assessments on our behalf.

The information we receive from consumer reporting agencies and background investigation providers may include publicly accessible information about you, as well as information held in databases maintained by those providers. ACIDC ensures that all third-party providers from whom it receives candidate information are bound by appropriate contractual data protection obligations and that such information is collected and used only in accordance with applicable law and this Notice.


How ACIDC Uses Your Personal Information

ACIDC uses the Personal Information we collect from or about you for a variety of purposes that are directly associated with the recruitment and hiring process. All uses of your Personal Information are grounded in a lawful basis as described in this Notice and in ACIDC’s commitment to handling your data responsibly, transparently, and proportionately. For example, ACIDC may use your Personal Information to:

  • communicate with you, including through the use of digital platforms, applicant tracking systems, email, telephone, and other recruitment tools, about role opportunities, recruitment events, community engagement initiatives, or for any other recruitment or hiring purpose;
  • process and evaluate job applications, make offers of employment or engagement, or enter into employment, service, or volunteer agreements with you;
  • assess an applicant’s suitability for a particular role, including whether an applicant meets any regulatory, grant-body, programmatic, or partner eligibility requirements, and their fitness to carry out the responsibilities of the role;
  • comply with our statutory, regulatory, and/or contractual obligations, which may include conducting lawful background checks, reference checks, and right-to-work verification in accordance with applicable law;
  • comply with our duty to make reasonable accommodations for job applicants with disabilities, ensuring that all candidates have an equal opportunity to demonstrate their suitability for a role regardless of any disability;
  • ensure compliance with an applicant’s statutory rights and any applicable equal opportunity, anti-discrimination, or affirmative action obligations;
  • review the effectiveness of our recruiting efforts and perform analytics on our applicant and candidate pool to ensure that our recruitment process is fair, efficient, and aligned with ACIDC’s mission and organizational values;
  • monitor recruitment statistics and/or meet other legal obligations, such as government reporting requirements, grant-body reporting obligations, funder monitoring requirements, or obligations arising under applicable employment or equality legislation;
  • maintain records of the recruitment process and evaluate and improve our recruitment processes on an ongoing basis to ensure they remain effective, lawful, and consistent with best practices; and
  • establish or defend against legal claims or exercise our legal rights in connection with our recruitment activities.

We use the Sensitive Personal Information or Special Category Data that we collect from or about you in connection with the following specific purposes, each of which is supported by a lawful basis as set out in the Lawful Bases table in this Notice:

  • to comply with applicable equal opportunity laws and other applicable legal requirements arising under employment, anti-discrimination, or equality legislation in the jurisdictions in which ACIDC operates;
  • to check whether applicants have the right to work in the jurisdiction in which a position is located, in compliance with applicable immigration and employment authorization laws;
  • to comply with employer health and safety obligations, including any obligations that arise in connection with the nature of the role or the environment in which it will be performed;
  • to verify that candidates are suitable for employment, engagement, or continued program participation, including where suitability depends on the results of background, health, or occupational fitness checks;
  • to perform obligations or exercise rights that are imposed on or available to ACIDC in its capacity as an employer, program operator, or grant recipient under applicable law; and
  • to monitor and identify the existence or absence of equality of opportunity or treatment between certain groups of people — including on the basis of race, ethnicity, gender, disability, or veteran status — with the aim of promoting and maintaining equal treatment and reporting aggregated equality and diversity statistics in support of ACIDC’s organizational mission and its commitments to its funders, partners, and the communities it serves.

We do not use or disclose Sensitive Personal Information for purposes that require us to give you the option to limit that use beyond what is set out in this Notice. We will always inform you at or before the point of collection if we intend to use your Sensitive Personal Information for any purpose beyond those described in this Notice, and we will seek your explicit consent for such use where required by applicable law.

We do not use the Personal Information we collect from or about you for automated decision-making or profiling that produces legal or similarly significant effects on you. ACIDC’s recruitment process relies on human judgment and evaluation at every meaningful stage of decision-making, including decisions about whether to progress an application, extend an offer, or decline a candidate. Third parties who help us identify individuals who might be interested in applying for a position at ACIDC — such as job board platforms or LinkedIn’s talent solutions — may use automated tools to recommend candidates; however, we do not control how these third parties process your Personal Information, and we encourage you to review the privacy notices of any such platforms you use to submit your information.

Additionally, we do not knowingly collect or process Personal Information about children under 16 years old in the context of recruitment. If we become aware that we have inadvertently collected Personal Information from an individual under the age of 16 in a recruitment context, we will promptly delete that information and notify the individual or their guardian as appropriate.


Lawful Bases for Processing EEA and U.K. Applicants’ Personal Information

Where ACIDC processes the Personal Information of individuals located in the European Economic Area (“EEA”) or the United Kingdom (“U.K.”), we are required by applicable data protection law — including the General Data Protection Regulation (GDPR) and the UK General Data Protection Regulation (UK GDPR) — to identify and rely upon a lawful basis for each processing activity. The table below sets out the lawful bases upon which ACIDC relies for each of the processing purposes described in this Notice. Where ACIDC processes Sensitive Personal Information or Special Category Data for individuals in the EEA or U.K., we also identify the additional condition under Article 9 of the GDPR or UK GDPR that permits such processing.

Otherwise, we rely on your express consent for processing any special category data for this purpose, and such consent may be withdrawn at any time.

Additional Information for Nigerian Applicants (Nigeria Data Protection Act 2023)

If you are located in Nigeria or applying for a position with ACIDC’s Nigerian operations or programs, the Nigeria Data Protection Act 2023 (“NDPA”) and the General Application and Implementation Directive 2025 (“GAID 2025”), issued by the Nigeria Data Protection Commission (“NDPC”), apply to ACIDC’s processing of your Personal Information. This section provides additional information specifically relevant to candidates located in Nigeria and supplements the general information set out in the rest of this Notice. Where there is any conflict between the general provisions of this Notice and the requirements of the NDPA or GAID 2025, the requirements of applicable Nigerian data protection law will prevail in respect of candidates located in Nigeria.

Data Controller (Nigeria)

For candidates applying for roles based in Nigeria or roles operated under ACIDC’s Nigerian programs, ACIDC operates as a data controller as defined under the NDPA 2023. As data controller, ACIDC is responsible for determining the purpose and means by which your Personal Information is processed in connection with recruitment and is accountable for ensuring that such processing complies with the principles and obligations set out in the NDPA 2023 and GAID 2025. Where ACIDC engages third-party service providers — such as applicant tracking system providers, background check vendors, or skills assessment platforms — to process candidate Personal Information on its behalf, those providers act as data processors under the NDPA and are required to process your Personal Information only on ACIDC’s documented instructions, in compliance with the NDPA, and subject to appropriate contractual data protection obligations. ACIDC maintains written data processing agreements with all processors that handle Nigerian candidates’ Personal Information.

Lawful Bases for Processing Under the NDPA

Under the NDPA 2023, ACIDC processes your Personal Information during the recruitment process on one or more of the following lawful bases, each of which is identified and documented by ACIDC prior to commencing the relevant processing activity:

  • Performance of a Contract or Pre-Contractual Steps — processing is necessary to take steps at your request prior to entering into an employment, engagement, or volunteer agreement with you, including evaluating your application, conducting interviews, and making an offer of employment or engagement;
  • Compliance with a Legal Obligation — processing is necessary for ACIDC to comply with applicable Nigerian legislation, including the Labour Act, the Employees’ Compensation Act, relevant immigration and work authorization requirements, and any applicable regulatory or funder reporting obligations;
  • Legitimate Interests — processing is necessary for the purposes of ACIDC’s legitimate interests in managing its recruitment and hiring activities, evaluating applicants, maintaining accurate and complete recruitment records, and improving its processes, provided that such interests are not overridden by your fundamental rights and freedoms as a data subject under the NDPA; and
  • Consent — where none of the above lawful bases applies, or where the NDPA or GAID 2025 requires explicit consent for a specific processing activity, ACIDC will seek your express, informed, specific, freely given, and unambiguous consent before processing your Personal Information for that purpose. Where consent is the lawful basis for processing, you have the right to withdraw that consent at any time, and ACIDC will cease processing your Personal Information for that purpose without delay upon receipt of your withdrawal.

Privacy Notice Obligation (Nigeria)

In accordance with Section 34 of the NDPA 2023 and the requirements of the GAID 2025, ACIDC is required to provide you with clear, transparent, and accessible information about how your Personal Information is collected and used from the first point at which your data is collected. This Recruitment Privacy Notice fulfils ACIDC’s obligation under Section 34. ACIDC will not collect Personal Information from Nigerian candidates without first making this Notice available to them in a form that is reasonably accessible and comprehensible. Cross-Border Transfers of Personal Information (Nigeria)

Where ACIDC transfers your Personal Information outside Nigeria — for example, to service providers, partner organizations, or affiliated entities located in other countries — ACIDC will ensure that such transfers comply with the cross-border data transfer requirements of the NDPA 2023. This means that ACIDC will only transfer your Personal Information to countries or organizations that: (i) provide an adequate level of data protection as recognized by the NDPC; (ii) are subject to binding contractual data protection obligations equivalent in effect to those imposed under the NDPA, such as standard contractual clauses approved by or consistent with the requirements of the NDPC; or (iii) are the subject of another lawful transfer mechanism recognized under the NDPA 2023 and GAID 2025. You may contact ACIDC at privacy@acidc.site to request information about the specific safeguards applied to any transfer of your Personal Information outside Nigeria.

Your Rights Under the NDPA

As a candidate located in Nigeria, you have the following rights in relation to your Personal Information under the NDPA 2023:

  • Right to Information (Section 34 NDPA) — the right to be informed, at or before the point at which your Personal Information is collected, about whether your Personal Information is being processed, the purposes of processing, the categories of data being processed, the recipients or categories of recipients of your data, the applicable retention periods, and the existence of any automated decision-making;
  • Right of Access — the right to obtain confirmation of whether ACIDC holds Personal Information about you, and to receive a copy of that Personal Information together with supplementary information about how it is collected, used, and disclosed;
  • Right to Rectification — the right to request the correction of any Personal Information held by ACIDC that is inaccurate, outdated, or incomplete, without undue delay;
  • Right to Erasure — the right to request the deletion or destruction of your Personal Information where it is no longer necessary for the purposes for which it was collected, where you have withdrawn your consent and no other lawful basis applies, or where processing is unlawful, subject to ACIDC’s applicable legal retention obligations;
  • Right to Object (Section 36 NDPA) — the right to object to the processing of your Personal Information at any time, particularly where processing is based on ACIDC’s legitimate interests, on grounds relating to your particular situation. ACIDC will cease processing upon receipt of a valid objection unless it can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or where processing is necessary for the establishment, exercise, or defense of legal claims;
  • Right to Withdraw Consent (Section 35 NDPA) — where ACIDC relies on your consent as the lawful basis for processing your Personal Information, you have the right to withdraw that consent at any time by contacting us at privacy@acidc.site. Withdrawal of consent will not affect the lawfulness of any processing carried out before its withdrawal; and
  • Right to Security and Breach Notification (Sections 39–41 NDPA) — ACIDC is required under the NDPA to implement appropriate security measures to protect your Personal Information and to notify the NDPC within 72 hours of becoming aware of a personal data breach that is likely to result in a risk to your rights and freedoms. Where the breach is likely to result in a high risk to you, ACIDC will also notify you directly without undue delay.

How to Submit a Privacy Request or Complaint (Nigeria)

To exercise any of your rights under the NDPA 2023, or to raise a concern about ACIDC’s handling of your Personal Information, please contact ACIDC atprivacy@acidc.site and include “Nigeria Data Protection Request” in the subject line. ACIDC will acknowledge receipt within five (5) business days and resolve your request within the timeframe prescribed by the NDPA 2023 and GAID 2025. We may need to verify your identity before processing certain requests.

If you are not satisfied with ACIDC’s response, you may escalate your complaint using the Standard Notice to Address Grievance (“SNAG”) mechanism introduced under the GAID 2025, which requires you to formally raise your privacy concern with ACIDC as a preliminary step before escalating to the NDPC. If your complaint remains unresolved after engaging with ACIDC directly, you may file a formal complaint with the Nigeria Data Protection Commission (NDPC) at ndpc.gov.ng. Non-compliance with the NDPA may attract administrative fines of up to ₦10,000,000 (ten million Naira) or 2% of ACIDC’s gross annual revenue in the preceding financial year, whichever is greater, as well as enforcement orders and civil liability.

Additional Information for Caribbean Applicants

ACIDC operates across multiple Caribbean jurisdictions, including Jamaica, Trinidad and Tobago, Barbados, Antigua and Barbuda, Guyana, Grenada, and other member states of the Organisation of Eastern Caribbean States (“OECS”). Each of these jurisdictions has enacted or adopted its own data protection legislation, imposing specific obligations on organizations that collect and process personal data within those territories. This section provides jurisdiction-specific information for candidates located in Caribbean territories and supplements the general information set out in the rest of this Notice. Where this section identifies requirements of a Caribbean jurisdiction’s data protection law that go beyond the general provisions of this Notice, ACIDC will comply with those jurisdiction-specific requirements in respect of candidates in that territory. Jamaica — Data Protection Act 2020

If you are located in Jamaica or applying for a role based in Jamaica, the Data Protection Act 2020 (Act No. 19 of 2020) (“DPA Jamaica”), which came into full operative effect on December 1, 2023, governs ACIDC’s collection and processing of your Personal Information. The supervisory authority responsible for overseeing compliance with the DPA Jamaica is the Office of the Information Commissioner (“OIC”), accessible at oic.gov.jm.

Under the DPA Jamaica, ACIDC processes your Personal Information on one or more of the following lawful bases: the performance of pre-contractual steps taken at your request; compliance with a legal obligation applicable to ACIDC in Jamaica; the pursuit of ACIDC’s legitimate interests in managing recruitment and hiring activities, where those interests are not overridden by your rights and freedoms; or your freely given, specific, informed, and unambiguous consent where required. ACIDC collects only the Personal Information that is necessary and proportionate to the legitimate recruitment purpose for which it is collected, consistent with the data minimization principle under the DPA Jamaica.

As a candidate in Jamaica, you have the following rights under the DPA Jamaica: the right to be informed about the collection and use of your Personal Information; the right of access to Personal Information held about you; the right to rectification of inaccurate or incomplete data; the right to erasure of your Personal Information in applicable circumstances; the right to restrict or object to processing; the right to data portability; and the right not to be subject to solely automated decision-making that produces legal or similarly significant effects. You also have the right to lodge a complaint with the OIC if you believe that ACIDC has not handled your Personal Information in accordance with the DPA Jamaica.

Where ACIDC transfers your Personal Information outside Jamaica, ACIDC will rely on standard contractual clauses or other safeguards recognized under the DPA Jamaica to ensure that your data remains protected to a standard equivalent to that provided under Jamaican law. ACIDC will notify the OIC and affected candidates of data breaches within 72 hours of discovery, in accordance with the DPA Jamaica. Penalties under the DPA Jamaica for corporate bodies may reach up to 4% of annual global gross turnover. Grenada and Other OECS Jurisdictions (St. Kitts and Nevis and Other Member States)

ACIDC also operates in or recruits from other member states of the Organisation of Eastern Caribbean States (“OECS”), including Grenada, St. Kitts and Nevis, and other territories that have adopted or are in the process of adopting data protection frameworks based on the OECS Data Protection Model Bill or their own national legislation. In these jurisdictions, ACIDC applies data protection principles that are consistent with the OECS Model Bill framework, including the principles of lawfulness, fairness, and transparency; purpose limitation; data minimisation; accuracy; security; and accountability. Candidates in these jurisdictions have the right to be informed about the processing of their Personal Information, the right of access, the right to rectification, and the right to lodge a complaint with the relevant local data protection or information authority. Caribbean Cross-Border Data Transfers

Where ACIDC transfers Personal Information across borders — whether within the Caribbean region, from the Caribbean to the United States or another jurisdiction, or between ACIDC’s entities and service providers in different countries — ACIDC takes appropriate and documented measures to ensure that your Personal Information remains protected in accordance with the data protection law of your home jurisdiction. These measures include, as applicable: standard contractual clauses recognized by the relevant supervisory authority; adequacy assessments confirming that the destination jurisdiction provides an equivalent level of data protection; data transfer agreements negotiated with specific third-party service providers; or, where required, your explicit and informed consent to the specific transfer. ACIDC will not transfer your Personal Information to a third country or territory unless one of these transfer mechanisms is in place. How to Submit a Privacy Request or Complaint (Caribbean)

Candidates located in Caribbean jurisdictions may exercise their data subject rights by contacting ACIDC directly at privacy@acidc.site and including “Caribbean Data Protection Request” and the name of your jurisdiction in the subject line of your message. ACIDC will acknowledge all requests within five (5) business days and will respond within the timeframe required by the applicable data protection law of your jurisdiction. We may need to verify your identity before processing certain requests. If you are not satisfied with ACIDC’s response, you may escalate your complaint to the relevant supervisory authority in your jurisdiction, as listed in the table below:

Communication with You About Future Job Opportunities

ACIDC typically relies on your consent when we communicate with you about job opportunities, recruitment events, volunteer placements, community engagement initiatives, or for other recruitment purposes after the conclusion of your application — whether or not that application was successful. Where ACIDC contacts you about future opportunities based on your consent, we will maintain a clear record of the consent you provided, including the date, manner, and scope of that consent. We will also ensure that any ongoing communication we send you is consistent with the scope of your consent and that you can easily identify ACIDC as the sender of those communications.

If you no longer wish to receive such communications, you can revoke your consent at any time, and we will cease processing your Personal Information for this purpose without delay. The withdrawal of your consent will not affect the lawfulness of any processing carried out prior to the withdrawal. To stop receiving email communications from us, you can click on the “unsubscribe” link at the bottom of the emails you receive from us, or you can contact us directly at privacy@acidc.site with a request to be removed from our recruitment mailing list. If you would like to stop receiving text messages, WhatsApp messages, or other digital communications from us in connection with future opportunities, you can opt out at any time by following the opt-out instructions included in those messages or by contacting us at the details provided in the Questions section of this Notice. You can also opt out of receiving recruiting messages from us by emailing privacy@acidc.site and clearly stating the type of communication you no longer wish to receive.

Please note that, even if you opt out of future recruitment communications, ACIDC may still need to contact you in connection with your existing application, a pending offer, or any administrative or legal matter arising from your participation in the recruitment process. Such communications are necessary for the performance of our obligations and do not require your consent under applicable law.


Who Has Access to Your Personal Information

ACIDC provides access to the Personal Information it collects from or about you only to ACIDC staff, volunteers, and representatives who require such access to perform their duties in connection with the recruitment and hiring process. Access to candidate Personal Information is governed by ACIDC’s internal access control policies, which limit access to those with a legitimate need to view or process that information in connection with specific recruitment activities. For example, ACIDC may share your Personal Information within our organization with:

  • Human Resources (HR) and recruitment team members who are responsible for managing the recruitment process, communicating with candidates, and maintaining recruitment records;
  • interviewers and panel members who are involved in assessing candidates for specific roles, to the extent necessary for them to carry out their evaluation responsibilities;
  • hiring managers and program directors who are responsible for the positions being filled and who need to review candidate information to make informed hiring decisions;
  • IT and systems administration staff who support and maintain ACIDC’s recruitment and HR management systems and who may need access to candidate data in the course of providing technical support or system maintenance;
  • compliance, legal, and finance personnel who may need access to candidate information to ensure that ACIDC’s recruitment activities comply with applicable legal, regulatory, and funder requirements; and
  • senior organizational leadership, where required to authorize or review hiring decisions for certain roles or to fulfill reporting or governance obligations.

All ACIDC personnel with access to candidate Personal Information are bound by contractual obligations of confidentiality and are required to handle that information in accordance with ACIDC’s data protection policies and applicable law. ACIDC provides regular training to all staff with recruitment responsibilities to ensure that they understand and comply with their data protection obligations.


How ACIDC Discloses Your Personal Information

ACIDC discloses your Personal Information to service providers and contractors who need access to this information to provide products and services to ACIDC relating to our recruitment and hiring activities. In all cases, ACIDC ensures that such service providers and contractors are bound by appropriate contractual data protection obligations, including obligations to process your Personal Information only in accordance with ACIDC’s instructions and applicable law, and to implement appropriate technical and organizational security measures. These service providers and contractors may include, for example:

  • applicant tracking system (ATS) providers who host and operate the platform through which candidates submit applications and through which ACIDC manages the recruitment process;
  • background check and consumer reporting vendors engaged to conduct pre-employment verification and screening in accordance with applicable law and ACIDC’s policies;
  • assessment platform providers who deliver skills assessments, competency evaluations, or other selection tools used as part of the recruitment process;
  • video interview platform providers used to facilitate remote or virtual interviews with candidates; and
  • communication tools and services used to contact candidates by email, telephone, or other digital channels.

We may also share your Personal Information with former employers or others you have listed in your job application to obtain references about you. Reference checks will be conducted only where we have informed you of our intention to contact references and, where required by applicable law, with your prior consent. We will not contact a current employer for a reference without your explicit permission.

In some cases, we may need to share your Personal Information with a funder, grant-making body, or partner organization if the role you are applying for is funded by or connected to that entity and where such sharing is necessary for compliance or reporting purposes. We will inform you of any such requirement at the time of your application or as soon as we become aware of it, and we will handle any such disclosure in accordance with applicable data protection law and our contractual obligations to you and to the relevant third party.

We may share your Personal Information with consumer reporting agencies to perform necessary background checks, as permitted by applicable law. ACIDC’s practices with respect to conducting reference checks and background searches vary depending on the country and jurisdiction in which the position you are applying for is located. If ACIDC performs, or directs a third party to perform, reference checks or background checks for a position for which you have applied, you will be asked to provide contact information for any references and written consent to any background checks, in accordance with applicable law. You will also be provided with any legally required disclosures regarding the use of consumer reporting agencies before any such checks are initiated.

We do not sell the Personal Information we collect from or about you to third parties, and we do not allow third parties to use this Personal Information for their own advertising, marketing, or other commercial purposes. ACIDC does not engage in the sale or sharing of candidate Personal Information for cross-context behavioral advertising.


Your Personal Information May Be Accessed Outside Your Country of Residence

ACIDC operates across multiple countries and jurisdictions, and the Personal Information we process about you may be stored and processed in any country where ACIDC or its affiliates, partner organizations, or service providers have facilities, operations, or personnel. Data protection laws in these countries may not provide the same level of protection for your Personal Information as is available in your country of residence, and the legal rights available to you in connection with the processing of your Personal Information may differ accordingly.

Where ACIDC transfers Personal Information to a country outside the EEA or U.K. that is not recognized as providing an adequate level of data protection by the relevant regulatory authority, ACIDC relies on a variety of legal mechanisms to ensure that your Personal Information continues to receive an appropriate level of protection in accordance with applicable data protection law. These mechanisms may include Standard Contractual Clauses (SCCs) approved by the European Commission or the U.K. Information Commissioner’s Office (ICO), binding corporate rules, or other transfer mechanisms recognized under applicable law. ACIDC also conducts Transfer Impact Assessments (TIAs) where required to evaluate the risks associated with specific international transfers and to implement any supplementary safeguards that may be necessary to protect the rights and freedoms of individuals whose data is being transferred.

How Your Personal Information Is Protected

The integrity, availability, confidentiality, and security of your Personal Information matters to us. ACIDC recognizes that the Personal Information collected in connection with the recruitment process is often sensitive in nature, and we take our responsibility to protect it seriously. To safeguard your Personal Information, ACIDC has put in place reasonable and appropriate technical and organizational policies, procedures, and controls designed to protect Personal Information from loss, accidental destruction, misuse, or unauthorized disclosure or access. The specific security measures we employ include, but are not limited to:

  • Encryption of data in transit and at rest using industry-standard protocols, ensuring that candidate information transmitted to or stored within ACIDC’s systems is protected from interception or unauthorized access;
  • Role-based access controls that restrict access to candidate Personal Information to those ACIDC personnel and authorized service providers who have a legitimate need to access that information in connection with recruitment activities;
  • Secure, access-controlled applicant tracking and HR management systems that have been assessed against applicable security standards and are subject to ongoing monitoring and maintenance;
  • Regular staff training and awareness programs covering data protection obligations, confidentiality requirements, and the appropriate handling of candidate Personal Information;
  • Periodic review, testing, and audit of our data security arrangements, including vulnerability assessments and, where appropriate, third-party security reviews; and
  • Contractual data security obligations imposed on all third-party processors and service providers who handle candidate Personal Information on behalf of ACIDC, ensuring that they maintain security standards consistent with our own.

Notwithstanding these measures, no method of electronic data transmission or storage is entirely secure, and ACIDC cannot guarantee the absolute security of your Personal Information against all possible threats or incidents. We will, however, respond promptly and effectively to any security incident or breach that affects candidate Personal Information. In the event of a data breach that is likely to result in a risk to your rights and freedoms, ACIDC will notify you and applicable regulatory authorities as required by law without undue delay, and will take all necessary steps to mitigate the impact of the breach and to prevent recurrence.

ACIDC also maintains a data breach response policy and incident management procedures, and designated personnel are responsible for coordinating ACIDC’s response to any security incident involving Personal Information. We review and update our security measures on a regular basis to ensure that they remain appropriate in light of evolving threats and technological developments.


How Long ACIDC Keeps Your Personal Information

ACIDC retains the Personal Information we collect from or about you for the period of time needed to process it for its intended purpose and to comply with any contractual, statutory, or regulatory obligations to which ACIDC may be subject. The period of time that ACIDC retains your Personal Information will depend on the country or jurisdiction in which the position for which you apply is located, the nature of the role, the outcome of the recruitment process, and the specific purpose for which ACIDC collected your Personal Information. ACIDC applies the principle of data minimization throughout the retention lifecycle, retaining only the information that is necessary for the purposes identified in this Notice and deleting or anonymizing Personal Information when it is no longer required.

If you apply for a position and accept an offer of employment or engagement from ACIDC, we will retain any Personal Information collected from or about you during the recruitment process in accordance with our internal policies and procedures pertaining to the retention of employee and contractor Personal Information. Your recruitment file will be incorporated into your employee or contractor record and retained for the duration of your engagement with ACIDC and for such period thereafter as is required by applicable law, ACIDC’s internal policies, or our obligations to funders and regulatory bodies.

If you apply for a position but your application is not successful — whether because ACIDC declines to proceed with your application, you withdraw from the process, or you decline an offer — we will retain your Personal Information for a period of time, typically six (6) months to four (4) years, which may vary depending on the country or jurisdiction in which the position is located, the specific legal retention obligations applicable in that jurisdiction, and the nature of the information collected. ACIDC will review the retention period applicable to your Personal Information at the time of collection and will communicate the applicable retention period to you where required by law.

ACIDC may retain your Personal Information beyond the standard recruitment retention period for the following purposes, where permitted by applicable law: to consider you for other suitable positions or program opportunities with ACIDC or its affiliated entities (subject to your consent where required); to comply with applicable legal retention requirements, including those arising under employment, tax, immigration, or equality legislation; to protect ACIDC’s interests in the event of a legal challenge to ACIDC’s recruitment and hiring actions, including claims of discrimination, breach of contract, or other employment-related claims; and to help us better understand and improve our recruitment process through the use of aggregated and anonymized analytics.

If you would like ACIDC to delete your Personal Information, you can submit a deletion request in accordance with the process set out in the section of this Notice titled “Your Rights Related to Your Personal Information.” Please note that ACIDC may be required to retain your Personal Information following your deletion request if we are subject to an applicable legal retention obligation or if your information is relevant to an ongoing or anticipated legal proceeding. If we are unable to delete your Personal Information, we will respond to your request with a clear explanation of the reasons we are unable to do so, and we will identify any specific categories of information that we are required to retain and the legal basis for that retention.


Your Rights Related to Your Personal Information

Depending on where you live and the applicable laws of your jurisdiction, you may have certain rights with respect to our processing of your Personal Information. ACIDC is committed to respecting and facilitating the exercise of these rights in accordance with applicable law. These rights may include, but are not limited to, the following:

  • the right to access the Personal Information that ACIDC holds about you and to receive information about how we use and disclose it;
  • the right to request the deletion of your Personal Information, subject to any applicable legal retention obligations or other grounds on which ACIDC may be permitted to retain it;
  • the right to data portability, meaning the right to receive a copy of your Personal Information in a structured, commonly used, and machine-readable format and, where technically feasible, to have that information transferred to another controller;
  • the right to correct or rectify inaccurate or incomplete Personal Information that ACIDC holds about you;
  • the right to restrict our processing of your Personal Information in certain circumstances, for example where you contest the accuracy of that information or object to our processing of it;
  • the right not to be subject to solely automated decision-making, including profiling, that produces legal or similarly significant effects on you;
  • the right to know what categories of Personal Information ACIDC collects about you and for what purposes that information is collected and used;
  • the right to opt-out of any sale or sharing of your Personal Information, to the extent that such activities occur;
  • the right to know the specific pieces of Personal Information that ACIDC has collected about you in the preceding twelve months;
  • the right to limit our use and disclosure of Sensitive Personal Information to the purposes for which it was originally collected or as otherwise permitted by applicable law;
  • the right to withdraw your consent to our processing of Personal Information at any time, where our processing is based on your consent, without affecting the lawfulness of processing carried out prior to the withdrawal;
  • the right to object to our processing of your Personal Information where that processing is based on legitimate interests, on the grounds relating to your particular situation; and
  • the right not to receive discriminatory treatment for exercising any of your data subject rights.

If you are a resident of California, the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) provide you with additional rights with respect to your Personal Information, including the right to opt out of the sale or sharing of your Personal Information and the right to limit the use of Sensitive Personal Information. If you live in any other country or state that provides data subject rights for applicants, prospects, or candidates — including under state privacy laws in Virginia, Colorado, Connecticut, Texas, Utah, or other applicable jurisdictions — you may exercise these rights by contacting us using the information provided in the Questions section of this Notice. ACIDC will handle your request in accordance with the requirements of applicable law.

Please note that the rights described in this section are not absolute, and exceptions may apply. ACIDC will handle all rights requests on a case-by-case basis, taking into account the nature of the request, the applicable legal framework, and any competing considerations such as legal retention obligations or the rights of third parties. If ACIDC determines, upon reviewing your request, that it is unable to comply fully or in part, we will respond to inform you of the specific reasons that prevent us from doing so and of any alternative steps that may be available to you. We will acknowledge receipt of your request within a reasonable timeframe and will respond to all verifiable requests within 30 days or within the timeframe required by applicable law, with the possibility of one extension where permitted.

If you believe that ACIDC has not complied with or properly responded to any such request, we ask that you let us know by email at privacy@acidc.site so that we may address your concern promptly and directly. However, you also have the right to file a complaint with the appropriate Data Protection Authority or government agency in the jurisdiction where you live, and we will not take any adverse action against you for doing so.


If You Do Not Provide Personal Information

You are under no statutory or contractual obligation to provide any Personal Information or other information to ACIDC during the recruitment process. The decision to apply for a position with ACIDC and to provide the Personal Information requested as part of that process is entirely voluntary. However, if you do not provide the information we request, we may not be able to process your employment or engagement application properly or at all, and we may not be able to assess your suitability for the role you have applied for or to verify that you meet the requirements of that role.

Where ACIDC requests specific categories of Personal Information in connection with legal or regulatory requirements — such as right-to-work documentation, background check authorization, or information required by a program funder — failure to provide that information may mean that ACIDC is unable to proceed with your application regardless of your suitability for the role on other grounds. In such cases, ACIDC will inform you of the specific information required, the reason it is required, and the consequences of failing to provide it, so that you can make an informed decision about whether to proceed with your application.

The provision of certain categories of Personal Information, including information about disability status, race or ethnicity, gender, and veteran or national service status, is entirely voluntary and optional. Your decision not to provide this information will not affect the evaluation of your application or ACIDC’s decision about whether to offer you a role. We encourage all applicants to provide this information where they are comfortable doing so, as it helps ACIDC to fulfill its diversity and equality monitoring obligations and to ensure that its recruitment process is fair and inclusive. However, we respect and will honor any decision not to provide it.

Allocation of Responsibility Between Joint Controllers

Where ACIDC operates as a joint controller with another ACIDC entity or program office in respect of the Personal Information of individuals in the EEA or U.K., ACIDC has entered into a joint controllership arrangement that clearly defines how the responsibilities of each controller under applicable data protection law are allocated between the parties. The key aspects of this allocation are set out below. This allocation is intended to ensure that individuals in the EEA or U.K. are able to exercise their rights effectively and receive clear and transparent information about the processing of their Personal Information, regardless of which ACIDC entity or program office they apply to.

  • Information about how we use your Personal Information: The ACIDC entity or program office you apply to will provide you, on behalf of ACIDC’s principal office, with information about how your Personal Information is used by us as joint controllers, including by making this Notice available to you at or before the point of collection of your Personal Information.
  • Your rights: The entity or program office that you apply to will serve as the primary contact point for the exercise of your rights in respect of the Personal Information we process as joint controllers, as set out in this Notice. If you would like to exercise your rights, including the right to access, correct, delete, or restrict our processing of your Personal Information, you can do so by contacting privacy@acidc.site. ACIDC will coordinate internally to ensure that your request is handled appropriately by the relevant joint controller(s).
  • Security: Each ACIDC entity and program office will maintain its own appropriate technical and organizational security measures to ensure that the Personal Information we process as joint controllers is kept secure in accordance with this Notice and applicable data protection law. Responsibility for implementing and maintaining security measures is shared between the joint controllers in proportion to the processing activities each undertakes.
  • Lawfulness: Each entity has determined the lawful basis relied on for processing your Personal Information as joint controllers, as set out in the Lawful Bases table in this Notice. Responsibility for ensuring that processing is conducted on a valid lawful basis rests with the entity that carries out each specific processing activity.
  • Transfers: Each entity has implemented its own appropriate safeguards for any international transfers of your Personal Information, including transfers to jurisdictions outside the U.K. or EEA, in accordance with applicable data protection law. Where transfers occur between joint controllers in different jurisdictions, the parties ensure that appropriate transfer mechanisms are in place prior to any such transfer.

Notwithstanding this allocation of responsibilities, individuals in the EEA and U.K. may exercise their rights against either of the joint controllers, regardless of which party is designated as the primary contact for a given type of request. ACIDC’s principal office will cooperate with any other joint controller to ensure that rights requests are honored in a timely and effective manner.
